Spanish tax for residents and non-residents in Cartagena.
Given the consequences of any omission or error, paying the correct tax at the correct time has become a key issue for anyone with economic ties to Spain.
Why Use a Tax Lawyer in Cartagena Rather Than Asking Around
Our job isto make sure you have no problems.
For reasons that are hard to understand, tax is a subject on which non-nationals — resident or not — too often take their lead from a friend's comment rather than from professional advice.
Our job is to make sure our clients have no problems. To do that we pay the right amount of tax, at the right time, on your behalf. So you don't have to worry about it.
Are you a Tax Resident in Spain?
If you live in Spain for more than 183 days in a calendar year, you are deemed a tax resident. That means you pay your taxes in Spain — not in the UK, and not in any other country you have lived in.
There are only a handful of exceptions, set out in the Personal Income Tax Law (IRPF) or in the international double taxation conventions. If you are told otherwise, it is not true.
Do not lose sight of this: tax residents are all of us who live in Spain.
Resident Tax
Your Annual IRPF Declaration
If you are resident, you must file your tax declaration every year between April and June.
To keep you compliant, we ask you for details of your income, prepare the declaration, and have you confirm the figures before we submit it online to the Spanish Tax Agency (AEAT).
Assets held abroad — the Modelo 720
Any property or investment held outside Spain with a value of more than €50,000 must be declared. This is the declaration of assets abroad, known as the Modelo 720, and it is separate from your income tax return.
Non-Resident Tax
If you own property in Spain
If residents commonly assume they owe nothing in Spain because they pay tax at home, non-residents assume it even more often. The reality is that you do have to pay — and the most common trigger is simply owning a property in Spain.
Why we file in November
We take the view that the money is better in our clients' pockets than in the Government's. For that reason we submit our clients' declarations in November and December each year, rather than early.
What we need from you
Except in unusual cases, a copy of the purchase deed and the last IBI receipt are all we need to prepare the return. We then e-mail you a draft, ask you to confirm the figures, and submit it to the AEAT once approved.
Tell us about your situation.
We do not work for developers or estate agents. Our only client in the transaction is you.
